Welcome to Wombat Pharmacy. These Terms of Service ("Terms") set out the rules for using our website and ordering products from us, whether for online delivery or in-store click & collect at any of our six stores across NSW, VIC and QLD.
1. Acceptance of these Terms
By accessing our website, creating an account, or placing an order, you agree to be bound by these Terms and the policies referred to in them (including our Privacy Policy and Refund & Returns Policy). If you do not agree, please do not use our website or place an order.
2. Who we are

3. Eligibility and age
To place an order you must be at least 18 and able to enter a legally binding contract. Some products, including certain medicines and therapeutic goods, have age restrictions and may only be supplied where permitted by law. We may ask you to verify your age or other details before accepting or supplying an order.
4. Not a substitute for professional medical advice
Information on our website is general information only — it is not medical advice and is not a substitute for advice from a qualified health professional who knows your circumstances.
- Always read the label and follow the directions for use. If symptoms persist, talk to your doctor or pharmacist.
- Consult your GP or pharmacist before starting, stopping or changing any medicine, particularly if you are pregnant or breastfeeding, taking other medicines, or have an existing condition.
- In an emergency, or if someone's health is at serious risk, call 000 immediately or attend your nearest hospital emergency department. You can also contact Poisons Information on 13 11 26.
5. Medicines, pharmacist discretion and correct use
We supply over-the-counter medicines, therapeutic goods, vitamins and other health products in line with Australian law and pharmacy practice standards. Prescription items are dispensed and checked by a qualified pharmacist, and a valid prescription must be provided where required. Pharmacy-only and pharmacist-only medicines may be subject to questions, quantity limits or supply restrictions. Our pharmacists may, at their professional discretion and consistent with their legal and ethical obligations, decline or limit the supply of any medicine or therapeutic good. Please use all medicines strictly per the label and any advice given, and keep them out of reach of children. If a pharmacist is unable to supply an item you ordered, we'll let you know and refund that item.
6. Pricing and availability
We try to keep prices, details and availability accurate, but they may change without notice and products may sell out. Prices are in Australian dollars (AUD) and, where applicable, include GST. If a product is listed with an incorrect price or description, we are not obliged to supply it at the incorrect price; we'll contact you to confirm whether to proceed at the correct price or cancel for a refund.
7. Orders and our acceptance
Placing an order is an offer to purchase. Any acknowledgement email does not mean your order is accepted. A contract is formed only when we accept your order — when we dispatch the products (delivery) or notify you it's ready for collection (click & collect). We may decline or cancel an order, in whole or part, for reasons including unavailable stock, a pricing/description error, a pharmacist declining supply, suspected fraud or misuse, or inability to verify details. If we cancel after payment, we refund the affected amount.
8. Intellectual property
All content on our website — text, logos, branding, images, graphics, layout and design — is owned by or licensed to Wombat Pharmacy and protected by intellectual property laws. You may use the website for personal, non-commercial purposes only, and must not copy, reproduce, modify, distribute or commercially exploit any part without our prior written permission.
9. Limitation of liability
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded. To the extent permitted by law, our website and content are provided on an "as is" and "as available" basis; we are not liable for loss arising from your use of or reliance on the website except to the extent caused by our breach of the ACL or our negligence; and where liability can be limited, it is limited (at our option) to resupplying the goods or services or paying the cost of resupply.
10. Privacy
We handle your personal and health information in accordance with our Privacy Policy and applicable Australian privacy laws. Please read our Privacy Policy to understand how we collect, use, store and protect your information.
11. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
12. Changes to these Terms
We may update these Terms from time to time. The current version is always available on our website, and the Terms that apply to your order are those in effect when you place it.
